ROGERSVILLE - Officers with the Hawkins County Sheriff's Office Narcotic Unit found a quantity of cocaine and a woman with a loaded pistol during a search of a Surgoinsville residence last Wednesday.
On June 10 officers executed a search warrant at 114 Ferry Road Lot 7, Surgoinsville, a residence occupied by Nicky Lee Day and Crystal Almond Day.
"As officers entered the residence Mrs. Day advised the officers that she was sitting on a pistol," according to the narrative of Crystal Day's arrest report.
The report notes officers did locate a Bryco 9 mm semi-automatic pistol "with one round in the chamber and five rounds in the magazine."
During a search of the residence officers reportedly locate 35 grams of powder cocaine, two sets of digital scales, baggies, a small amount of marijuana, rolling papers, grinders and pill crushers.
Nicky Day was not at the residence when officers first arrived, but was observed driving westbound on Highway 346 when he turned onto Ferry Road. He was not wearing a seat belt and following a traffic stop by Sergeant Tony Allen it was determined Day's driver's license from North Carolina was suspended.
As a result of the search warrant Nicky Lee Day, 37, and Crystal Almond Day, 37, both of the Ferry Road address, were charged with possession of schedule II for resale, simple possession of marijuana, possession of drug paraphernalia, maintaining a dwelling where narcotics are housed, sold or used and possession of a firearm during commission of a felony. Nicky day was also charged with driving on a suspended license.
The two are scheduled for arraignment in Hawkins County General Sessions Court on June 22.
